We have focused on litigation techniques to reduce costs to the client while

contamination, and toxic tort law. We have handled in excess of 150 PST cases,
four of which have gone to trial. In addition, we have tried contamination
cases outside the underground storage tank arena, which present legal and factual
issues very similar to those encountered in petroleum storage tank cases. The

Standardized discovery and pleadings. Written
and deposition discovery can be a costly process in any case. We have standard
discovery tailored to property owners, retailers, distributors, and environmental
consultants. With a minimum amount of effort, these can be tailored to each case.
These requests encompass questions about environmental testing and assessment,
tank/line inspections and testing, soil and groundwater analyses, and hydrogeologic
background.
We have pre-prepared questions regarding damages, including lost business, property
depreciation, insurance coverage and health injuries. This discovery can be served
on a plaintiff quickly to "smoke out" the case at a very early stage without
investing too much time and expense.
Expert witness databases and relationships. Where
depositions are necessary, our storage tank teams have developed significant
expertise and experience and have standardized outlines they can tailor for fact
witnesses and environmental experts and property managers.
Solid relationships with regulatory agencies. Our
experienced team are skilled at cultivating relationships with the right people
in governmental agencies, including state and local health agencies, fire
departments, and public work departments, to insure that our requests for information
are promptly and comprehensively handled, all at minimal cost. Where needed, we can
negotiate the scope and implementation of corrective action plans with regulators.
