Holland & Hart appellate attorney Chris Jackson was quoted in Law Week Colorado’s April 19 article, “Supreme Court Dives Into Mens Rea, Online Context in Colorado Appeal on ‘True Threats’,” and The Denver Post April 19 article, “Colorado free speech case goes before U.S. Supreme Court.” Jackson discusses the Court’s reactions during oral arguments held on April 19 in the constitutional challenge to Colorado’s stalker law that will likely turn on whether the accused’s intent should be considered in determining whether comments are a “true threat” or protected speech.
In the Law Week Colorado article, Jackson shares, “I think that a reversal is very likely. I don’t think they’re likely to adopt the full most restrictive test that the petitioner advocated for, but I do think that they’re going to reverse the judgment and impose some kind of a mens rea standard.” Adding in The Denver Post article, “that if the court rules that way, Colorado likely will need to change its laws to align with the ruling.”
