Ensuring Compliance under the New HIPAA Reproductive Health Rule

In the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization, the Biden administration implemented the new HIPAA Reproductive Health Rule to prohibit healthcare providers from disclosing protected health information about reproductive healthcare for investigative purposes if the reproductive care was legal in the state in which it was rendered. While it is unclear whether the Trump administration will maintain the new Rule, healthcare providers, other covered entities, and business associates must comply with the Rule as of December 23, 2024.
