The Outdoor Industry generates significant sales in California – an estimated $92 billion in consumer spending on the outdoor recreation economy. The industry is not immune from Prop 65 liability – outdoor recreation companies have been a steady target of Prop 65 bounty hunter suits over the last couple of years.
What are the main chemicals that outdoor and recreation companies have been sued for?
- In general, outdoor manufacturers are sued in relation to the same Prop 65 chemicals common to other consumer products – heavy metals such as lead and and phthalates such as Bis(2-ethylhexyl) (DEHP) and Diisononyl phthalate (DINP).
- For example, recent suits include:
- DEHP in vinyl grips in bows, tools, hoses and other outdoor equipment
- DEHP and DINP in vests and hydration bladders, rain suits, running packs and dry bags,
- Lead in camp fittings, whistles and bike parts,
- Tris(1,3-dichloro-2-propyl) phosphate (TDCPP) in tent fabric.
